TermIQ Terms of Service

Effective August 2026. TermIQ is operated by Termiq Software, LLC, 7364 E Villanueva Dr, Orange, CA 92867. By subscribing to or using TermIQ, you agree to these terms with Termiq Software, LLC.

1. License — one seat, one user

Each subscription grants one named user a single-seat license with one active session at a time. Sharing credentials or license keys, or concurrent use by multiple people, is prohibited and voids the license without refund. Signing in on a new device ends the session on the previous device.

2. Pricing aid — not advice

TermIQ is an internal quoting and illustration aid. Calculations are provided as-is and must be verified against your institution’s approved rate cards, credit policy, and documentation before client delivery or commitment. TermIQ does not provide financial, legal, or tax advice and is not a system of record.

3. Your data and your customers' data

Quotes are computed in your browser. When a licensed seat saves a quote or structure, the saved item — including any customer name and deal terms you entered — is stored in TermIQ's cloud so it is available across your devices or your team; you can delete saved items at any time. Commission Tracker entries — deals, budgets, and goals — are likewise stored in TermIQ's cloud under your seat's license so they persist across your devices, and can be deleted in-app at any time. We store your email address, license key, and session status to operate licensing; team accounts additionally store seat lists, settings, usage counts, and an administrative audit log. Payment details are handled by Stripe. Details are in the Privacy Policy. You are responsible for having the right to enter your customers' information and for your own disclosure and compliance obligations to your customers and institution.

4. Billing and cancellation

Monthly plans ($9.99 per seat, plus $3 for the optional commission statements add-on or $4.99 for the Commission Tracker add-on) renew automatically each month until canceled through the Stripe receipt; cancellation takes effect at the end of the paid month. Annual plans ($99 per seat, plus $30 for the optional commission statements add-on or $50 for the Commission Tracker add-on) are a fixed one-year term paid up front: they do not renew automatically — the seat simply ends at the close of the year unless you choose to renew — and, outside the 30-day money-back guarantee below, they may not be canceled or refunded before the term finishes, except where required by law. Self-serve team seats (5+ seats purchased at checkout) bill and renew like the corresponding monthly or annual plan above, at the same per-seat rates; invoiced enterprise agreements remain separate. Prices may change with at least 30 days' notice, effective at your next renewal. Canceled, expired, or lapsed subscriptions deactivate automatically.

30-day money-back guarantee. Annual plans: full refund on request within 30 days of the first charge — email sales@termiq.app, no questions asked. Monthly plans: the first month's charge is refunded on request within 30 days of that charge. Refunds deactivate the associated license and any add-ons. Annual subscriptions include a 30-day money-back guarantee from the date of purchase. After those 30 days, annual subscriptions are non-cancellable and non-refundable for the remainder of the term; they do not auto-renew. Monthly subscriptions may be cancelled at any time and end at the close of the paid month.

Free trial. Trials provide full product access for 3 days from first use, in one browser, via a single-use emailed link — one trial per person. Trials include the Commission Tracker add-on. Trials require no payment method and end automatically; nothing converts to a paid plan unless you subscribe.

Professional tools; no legal, tax, or compliance advice. TermIQ provides calculation and document-preparation software. All outputs — quotes, amortization schedules, proposals, commission statements, and any disclosure documents — are prepared at your direction and delivered under your name, and you are solely responsible for their accuracy and for compliance with the laws that apply to your transactions, including state commercial-financing disclosure laws. TermIQ is not a law firm and does not provide legal advice. Have your own counsel review any compliance-sensitive document before delivering it to a customer. You must verify every figure and determination in any generated document before use; disclosure documents are drafts that require your verification and your counsel's review, and by generating or delivering one you accept sole responsibility for it. To the maximum extent permitted by law, TermIQ disclaims all warranties as to generated documents and all liability arising from their use or delivery.

5. Acceptable use

You may not use TermIQ unlawfully, misrepresent TermIQ outputs as a lender's binding offer, interfere with or probe the service or other users' data, or circumvent licensing. Team administrators are responsible for the accuracy of rate cards, branding, and proposal language they publish to their seats.

6. Intellectual property

TermIQ, including its software, design, and content, is protected by copyright. You may not copy, resell, sublicense, reverse-engineer, or redistribute it. Your quotes, proposals, and branding remain yours.

7. Disclaimers

TermIQ is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Calculations are estimates for internal use; TermIQ does not guarantee that any transaction will be approved, funded, or priced as illustrated, and is not responsible for decisions made in reliance on its outputs or for errors in data you or your administrator enter.

8. Limitation of liability and indemnity

To the maximum extent permitted by law, TermIQ is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or business, and total liability for all claims is limited to the amount you paid in the twelve months preceding the claim. You will defend and indemnify TermIQ against third-party claims arising from your use of the service, the data you enter, or your violation of these terms.

9. Referral program

TermIQ may issue personal referral codes. Buyers using a referral code receive the stated discount on their first payment; the referrer earns a commission on referred license revenue, payable 30 days after each payment, for the first 12 months of each referred license. Commissions are void where a payment is refunded or charged back, and on self-dealing or fraudulent activity. TermIQ may modify or terminate the referral program at any time; earned, matured commissions are honored.

10. Disputes, governing law, and arbitration

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be settled by binding individual arbitration in California under the rules of JAMS, and each party waives any right to a jury trial or to participate in a class action; either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision by emailing sales@termiq.app within 30 days of first accepting these terms.

11. Termination and changes

We may suspend or terminate licenses that violate these terms. We may modify the service or these terms; material changes will be reflected by the effective date above, and continued use after a change constitutes acceptance. If any provision is unenforceable, the remainder stays in effect. These terms and the Privacy Policy are the entire agreement between you and TermIQ.
